Terms of Use

1. Purpose and acceptance

These Terms of Use ("Terms") govern the use of the Buvettes.be site and application ("the Service"), published by the Service's publisher, reachable at contact@buvettes.be. By creating an account or using the Service, you unreservedly accept these Terms as well as the Disclaimer. If you do not accept these terms, you must not use the Service.

2. Description of the Service

Buvettes.be allows a manager to create one or more digital sales lists ("stands") for an event, enter items and prices, publish it via a link or QR code, and receive orders ("rounds") placed by the public. The Service offers a free access level, limited in number of items and in time, as well as paid "Event" (limited duration) and "Unlimited" (extended duration) access, on the terms and pricing displayed on the site at the time of purchase.

3. User account

Creating a manager account requires a name, a valid email address and a password. You are responsible for the confidentiality of your credentials and for any activity carried out from your account. You agree to provide accurate information and keep it up to date.

4. Purchases and no right of withdrawal / refund

Any purchase of an Event or Unlimited access for a stand is final and non-refundable, non-cancellable and non-exchangeable, regardless of the reason given (change of mind, cancellation of the event, under-use, incorrect tier selection, etc.), as soon as payment is confirmed. By placing an order, you expressly acknowledge that the Service constitutes digital content whose performance begins immediately at your express request (immediate provision of the stand), and you accordingly waive, to the extent permitted by law, any right of withdrawal applicable to distance contracts.

This absence of refund applies in the same way to all current or future paid tiers of the Service. An Event or Unlimited access that is unused or partially used before the expiry of its validity period does not give rise to any refund, whether total or partial, nor to any extension of its validity period.

5. No management of on-site payments

The Service is a presentation and order-taking tool. It never replaces the actual management of payments between the manager and their customers during the event: collection (cash, physical tokens, payment terminal, or any other means chosen by the manager) is organized and ensured exclusively by the manager, under their sole responsibility. Only the purchase of an Event or Unlimited access on Buvettes.be goes through an actual online payment, processed by a secure third-party payment provider (Stripe).

6. Proper use of the Service

You agree to use the Service exclusively through the standard paths provided by the interface (web pages and buttons provided for this purpose). Any use outside the Service's standard processes is strictly prohibited, including but not limited to:

sending direct requests to the Service's technical access points (endpoints/API) outside the provided interface; any modification, bypassing or disabling of the JavaScript code run by the site in order to alter its normal behavior (bypassing checks, falsifying quantities, prices or order statuses, etc.); automated or bulk data extraction ("scraping"); any attempt at unauthorized access to data or features reserved for other users or for the administration; any attempt to disrupt, overload or compromise the security, integrity or proper functioning of the Service.

Any violation of this article may result in the immediate suspension or deletion of the account concerned, without notice or refund, without prejudice to any legal action.

7. Content entered by managers

Each manager is solely responsible for the content they publish on their lists (text, prices, any images) and for its compliance with applicable laws (consumer law, labeling, licenses required to sell beverages, taxation, etc.). Buvettes.be exercises no prior control over this content and may remove or suspend access to a list whose content is manifestly unlawful or contrary to these Terms.

8. Availability and evolution of the Service

Buvettes.be strives to ensure continuous access to the Service without guaranteeing uninterrupted availability, and reserves the right to evolve, suspend or discontinue all or part of the Service, in particular for reasons of maintenance, security or technical evolution, with reasonable notice where possible.

9. Liability

To the extent permitted by law, Buvettes.be's liability cannot be engaged for any indirect damage resulting from the use of the Service, nor for the consequences of a use that does not comply with these Terms. See also the Disclaimer.

10. Termination

You may stop using the Service at any time. Buvettes.be may suspend or close an account in the event of a violation of these Terms, without this giving rise to any refund of access already purchased.

11. Changes to the Terms

These Terms may be modified at any time. The applicable version is the one published on this page on the date the Service is used. In the event of a substantial change, a reasonable effort will be made to inform registered users.

12. Governing law and disputes

These Terms are governed by Belgian law. Any dispute relating to their interpretation or performance shall, failing an amicable resolution, fall under the exclusive jurisdiction of the Belgian courts of the place of residence of the Service's publisher.
